These Terms & Conditions (“Terms”) govern access to and use of the modelcouples.network platform (the “Platform”). Please read them carefully.

Applicable law: Austrian law applies, excluding its conflict-of-law rules and the UN Sales Convention.
Consumer protection: If you act as a consumer under EU/EEA law, mandatory consumer protection rules of your habitual residence remain unaffected.
Jurisdiction: If you are a business user, the competent courts of Vienna, Austria shall have exclusive jurisdiction. If you are a consumer, proceedings may be brought in the courts of your place of residence or in Vienna, as provided by mandatory law.
The German version governs; an English translation may be provided for convenience.
The Platform is available only to adults (18+). By registering, you represent that you are at least 18 years old. Accounts for minors are not permitted.
The Platform provides visibility for models, model couples, photographers, videographers, wedding vendors, clients and other creatives. It enables community groups and event listings (e.g., styled shoots, retreats).
No brokerage, no payments: No bookings or sales are processed through the Platform; the Platform does not broker or participate in contracts between users.
Host-provider role: We provide technical infrastructure for profiles and user-generated content (“UGC”). There is no proactive content monitoring. We act as a hosting/intermediary service under EU law.
Use is voluntary and free. By registering, you enter into a user contract for access to the Platform under these Terms; there are no recurring fees.
Changes to the Terms: We may adapt these Terms for legal, technical or business reasons. We will notify you of material changes in advance by appropriate means. Continued use after the effective date constitutes acceptance.
Account closure: You may delete your account at any time in the settings. We may suspend/terminate accounts or remove content where necessary for legal compliance, risk prevention or to protect users and the Platform.
Information about personal data processing is set out in our Privacy Policy.
Your rights & licence: You retain copyright in your uploads. By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, publicly display and make available such content within the Platform and on our official social-media channels for the purpose of operating and promoting the Platform, including technical copies/reformatting. Any use outside the Platform and our official channels requires your separate written permission.
Third-party rights: Uploads of third-party content require written permission/licences. Where applicable, model releases, property releases and music licences must be obtained.
No sensitive data: Uploading special categories of personal data under Art. 9 GDPR (e.g., health data, political opinions, religious beliefs) is prohibited.
Prohibited content: Unlawful, infringing (including non-consensual imagery), misleading or harassing content is prohibited and may be removed.
Takedown/Notice: See Section 18 for the notice-and-action procedure.
Group creation: Registered users may create groups and thereby become Group Administrator, responsible for settings, visibility, memberships, moderation and compliance with law and these Terms.
User responsibility: Users are solely responsible for all content they publish/upload/share (texts, images, videos, links, documents, messages, etc.). All necessary rights must be held; third-party rights (copyright, trademark, personality, data protection) must not be infringed.
Platform’s role: There is no prior review/monitoring/approval of UGC. The Platform is not involved in negotiations, bookings, payments or other legal/commercial interactions between users. All legal relationships arise solely between the users involved.
Liability in groups: To the extent permitted by law, the Platform assumes no liability for group content, group activities or user interactions. Responsibility lies with the Group Administrator and the respective users.
Enforcement: We may remove/restrict content or groups and suspend/terminate accounts where required for compliance, risk prevention or user protection.
Member Reviews (Profile Reviews)
Function. Logged-in registered members may submit reviews on other members’ profiles, including star ratings (0–5) and, where enabled, text feedback and ratings across multiple criteria.
Eligibility to review. Only logged-in registered members can submit reviews. Visitors who are not logged in can view existing reviews but cannot submit reviews.
Rules for reviews. Reviews must be truthful, based on the reviewer’s own experience, and written in a factual manner. The following is prohibited: unlawful content, insults/defamation, hate/discrimination, harassment, spam/advertising, disclosure of personal data of third parties, or any content infringing third-party rights.
No manipulation. Fake, incentivised, purchased, or otherwise manipulated reviews are prohibited unless clearly disclosed and permitted by mandatory law.
Transparency on authenticity checks. Reviews can only be submitted by logged-in members. We do not verify whether the reviewer has actually worked with, booked, or otherwise interacted with the reviewed member [alternativ: “We verify this by …” nur wenn Sie es wirklich prüfen].
Moderation / removal. We may review, reject, hide, remove or disable reviews if there are indications of violations of these Terms or applicable law. There is no entitlement to publication or permanent availability. This is without prejudice to Section 18 (Notice & Action / DSA).
Reporting & response. Affected users can report reviews via the in-product reporting tool or support email. Where technically available, the reviewed member may post a response.
Licence. By submitting a review, the reviewer grants us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and make the review available on the Platform as required for operation and presentation.
Event listings (such as workshops, retreats, or similar events) can be published free of charge by users on the platform. All content and information related to each event is provided solely by the respective organizers. The provider of this platform, Krassmedia.at, Gudrunstraße 1/50, 1110 Vienna, Austria, assumes no responsibility for the accuracy, completeness, or timeliness of the submitted event information.
We are not liable for cancellations, changes, or the removal of events by organizers. Any agreements, payments, or claims related to event participation are concluded solely between users and organizers and fall outside the responsibility of the platform. The platform does not act as a contracting party and does not assume any liability or provide refunds in connection with published events. Public event listings are designed for open access and may be shared via social media using integrated privacy-friendly sharing tools. By submitting an event, organizers acknowledge and accept this visibility.
10.1 Scope of Paid Services
Use of the Platform remains free of charge. In addition, optional paid marketing and promotional services (“Paid Services”) are available, including:
– featured placement of profiles (models, vendors, photographers),
– promotion on official ModelCouples.Network social-media accounts,
– other advertising visibility packages.
10.2 Booking and Contract Formation
Paid Services are booked manually via written request (e.g. email to marketing@modelcouples.network). After request, users receive an individual PayPal payment link. No payments are processed through the Platform. The contract becomes binding only after full payment has been received.
10.3 Payment Method
Payments are processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg. The Platform does not process or store payment data; only confirmation of payment (transaction ID, amount, email) is received. 10.4 Prices and Invoicing
Prices are communicated prior to booking and include all applicable taxes. Invoices are issued electronically in compliance with Austrian tax law.
10.5 Performance and Duration
Services are provided after confirmed payment and remain active for the communicated duration (e.g. length of featured placement).
10.6 Right of Withdrawal (FAGG)
Consumers have a 14-day right of withdrawal under §§ 11 ff FAGG. To exercise the right, contact support@modelcouples.network.
If you request immediate performance before the expiry of this period and the service has been completed, you acknowledge that your withdrawal right expires (§ 18 Abs 1 Z 11 FAGG).
10.7 Refund Policy
Refunds are only granted where required by Austrian or EU consumer protection law. No refunds once a service has been fully delivered.
10.8 Liability
Except in cases of intent or gross negligence, the Platform is not liable for indirect or consequential losses relating to paid marketing visibility.
10.9 Applicable Law
Austrian law applies. Mandatory EU/EEA consumer protection rights remain unaffected.
Prohibition of External Advertising
Publishing, linking to, or promoting other platforms, networks, competitors, or external services that offer similar or competing functionalities is not permitted on the Platform, unless prior written approval has been granted by the Provider.
Permitted Self-Promotion
Users may present their own professional or creative work (e.g., as a model, photographer, vendor, or venue) as part of their profile, provided that such content serves the purpose of the Platform and does not redirect traffic or users to external commercial sites.
Unsolicited Advertising and Spam
Unsolicited advertising (“spam”), affiliate links, paid collaborations without disclosure, or the use of the Platform for third-party marketing activities are strictly prohibited. Such content may be removed by the Provider without prior notice.
Official Marketing Channels Only
Advertising and promotion are permitted exclusively through the Platform’s official, paid marketing features — including Featured Profiles, Featured Events, Venue Promotions, and Social-Media Campaigns. Any advertising outside these official features is not allowed.
Sanctions
In case of repeated or serious violations, the Provider may suspend the user account, remove the content, and — where applicable — retain paid marketing or promotion fees (see Section 10).
The Platform may provide privacy-conscious sharing tools for selected content to be shared on social media (e.g. event listings). By using these tools, you consent to the respective visibility and understand that public data (e.g. profile name, images, descriptions) may appear in social media previews.
Commercial users (e.g. photographers, agencies, service providers) may present relevant services. Unsolicited advertising/spam may be removed. We may review and remove such content at our discretion.
You must not:
(a) upload illegal/infringing content;
(b) impersonate others or misrepresent affiliations;
(c) mine/scrape contrary to applicable law or robots.txt;
(d) interfere with or circumvent technical measures;
(e) use automation (bots/scripts) to create accounts or post content;
(f) circumvent content restrictions.
Users must safeguard their login credentials, use strong passwords, and report security issues. Accounts must not be shared or sold. We may restrict access or take security measures to protect users and the Platform.
The Platform is provided “as is” and “as available” without any guarantee of uninterrupted or error-free operation. Maintenance windows, outages or feature limitations may occur.
No limitation for personal injury: Nothing in these Terms limits liability for death or personal injury, fraud or gross negligence, or any liability that cannot be excluded under mandatory law (including product liability where applicable).
Platform liability: To the maximum extent permitted by law, we are liable only for intent or gross negligence. We are not liable for: (i) user disputes or third-party claims arising from user content/interactions; (ii) data loss not caused by us; (iii) indirect/consequential damages that were not foreseeable.
Indemnity: You agree to indemnify us against third-party claims arising from your unlawful content or breaches of these Terms, except where caused by our fault.
Reporting: Allegedly illegal content can be reported via the in-product reporting tool or by email to support@modelcouples.network stating (i) URL/ID, (ii) description of the illegality, (iii) name/email, and (iv) a good-faith statement of accuracy.
Process: We review notices within a reasonable time and may remove/disable content, restrict functionalities, or suspend accounts/groups. Where required by law, we issue a Statement of Reasons and notify affected users.
Appeals: Affected users may appeal moderation decisions via the in-product form or by email. Without prejudice to this, you may use an independent out-of-court dispute settlement body recognised under the EU Digital Services Act (where available) or seek judicial remedies.
Trusted flaggers & authorities: We cooperate with trusted flaggers and competent authorities as required by law.
By uploading, submitting or otherwise making available any images or videos containing identifiable individuals, users confirm that they have obtained all necessary rights and explicit consent for publication in accordance with:
Article 6(1)(a) GDPR (valid consent of the data subject),
Section 78 of the Austrian Copyright Act (UrhG) (protection of likeness), and
any other applicable model, property or third-party rights.
Users also confirm that they either hold the necessary usage and publication rights to the uploaded media (e.g. from the photographer), or have properly obtained such rights from the copyright holder.
Image and video content may be published in particular:
across all areas of the platform www.modelcouples.network, including all subpages;
via the official social media channels of the platform (e.g. Instagram, Pinterest, Facebook).

The platform acts solely as a hosting provider under EU law and assumes no liability for missing, invalid or insufficient consent or rights. Legal responsibility for the lawfulness of the content lies solely with the respective users.
Any given consent may be withdrawn at any time with future effect under Article 7(3) GDPR by contacting support. In such cases, the affected content will be removed within a reasonable period, unless legal obligations require further retention.
If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The failure to enforce any right or provision shall not be deemed a waiver of such right or provision.

We process the following types of personal data:
Registration data: name, username, email address, date of birth for 18+ age verification, password hash
Profile data: location such as city and country, bio, profile image, uploads, profile settings, visibility preferences
Communication data: private messages, support requests, public posts, comments, reports, inquiries
Technical and log data: IP address, browser type, device data, operating system, session identifiers, cookies, server logs
Usage data: page visits, interactions, clicks, activity data, feature usage
Newsletter data: email address, double opt-in timestamp, IP address, consent status
Payment data: PayPal transaction confirmation data such as transaction ID, amount, payer name, payer email
Marketing-service data: profile visibility preferences, promotion status, submitted social media handles, related public content
Analytics data: consent-based statistics and usage data via Google Analytics
Advertising data: consent-based conversion and marketing measurement via Meta Pixel
Important: Please do not submit special categories of personal data under Article 9 GDPR, such as health data, biometric data, religious beliefs, or sexual orientation.
The Platform is intended for adult users aged 18 years or older. If we become aware that an account belongs to an underage person, the account may be suspended or deleted after review.
The Platform is designed as a professional and creative networking service in which user profiles may be visible to other registered users and, depending on the selected settings and the relevant section of the Platform, also to the public.
The following profile data may be visible depending on the user’s settings and profile type:

Bio or profile description
Profile images and other uploaded content
Instagram username or other voluntarily submitted social media handles
To the extent that profile visibility is an essential part of the requested Platform functionality, processing is based on Article 6(1)(b) GDPR.
To the extent that users voluntarily publish additional optional information, enable broader visibility, or agree to promotional use, processing is based on Article 6(1)(a) GDPR.
Users may change profile visibility settings at any time within their account or request account deletion. Withdrawal of consent applies for the future and does not affect prior lawful processing.

Where statutory retention obligations apply, relevant data is stored for the legally required period, including seven years under Austrian tax law where applicable.
We use Google reCAPTCHA to protect login areas, forms and relevant functions of the Platform against automated misuse, spam and malicious access.
Depending on technical implementation, personal data such as IP address, browser information, device information, referrer data and interaction data may be processed.
If consent is legally required before loading the service, the legal basis is Article 6(1)(a) GDPR in conjunction with § 165 TKG 2021.
Where reCAPTCHA is used solely in a necessary security context, the legal basis is Article 6(1)(f) GDPR.

We use cookies and similar technologies to ensure the technical operation of the Platform, store user preferences, maintain login sessions and, where enabled by the user, measure reach, analyze usage and load third-party content.
Where storage of information on a device or access to information already stored on a device is not strictly necessary for the service requested by the user, such technologies are used only after prior consent.
Legal basis: Article 6(1)(a) GDPR in conjunction with § 165 TKG 2021.
Strictly necessary technologies are used on the basis of Article 6(1)(f) GDPR and, where applicable, Article 6(1)(b) GDPR.
Users may give, refuse or withdraw consent at any time with future effect via the consent banner or consent settings.

8.1 Consent Management
We use a consent management solution to document and manage cookie and consent preferences.
In this context, consent status, time of decision, selected categories and technical information may be processed to comply with legal obligations and document whether consent was granted, refused or withdrawn.
Legal basis: Article 6(1)(c) GDPR, Article 6(1)(f) GDPR and where applicable § 165 TKG 2021.
8.2 Google Analytics
Where consent is granted, we use Google Analytics GA4 for website statistics, reach measurement, service improvement and performance analysis.
Depending on configuration, processed data may include IP-derived location, browser data, device data, pages viewed, session information, usage behaviour and interactions.
IP anonymization is enabled where applicable.

8.3 Meta Pixel
Where consent is granted, we use Meta Pixel for conversion measurement, campaign optimization, audience building and advertising performance analysis.
Processed data may include page views, browser data, device data, events and interactions.

8.4 Wistia Videos
Where videos hosted via Wistia are embedded, Wistia may process IP address, browser data, device data, video usage and interaction data.
Such content is loaded after consent where legally required.
Legal basis: Article 6(1)(a) GDPR in conjunction with § 165 TKG 2021.
8.5 Atlassian Jira Service Management / Service Desk
If support tools based on Atlassian are used, personal data entered in support requests and technical data may be processed to handle inquiries and maintain system security.
Legal basis: Article 6(1)(b),(f) GDPR and where applicable Article 6(1)(a) GDPR.
8.6 Social Media and Embedded Third-Party Content
The Platform may contain functions or content from providers such as Pinterest, TikTok, Facebook, Instagram, LinkedIn or map services.
Such content is loaded after consent where legally required.
When loaded, the provider may receive personal data such as IP address, browser data, device data, visited page information and interaction data.
Legal basis: Article 6(1)(a) GDPR in conjunction with § 165 TKG 2021.
Selected profiles, events or public Platform content may be featured on social media channels where users have consented or submitted content for promotion.

The Platform uses infrastructure located within the European Union.
Email hosting services are provided by world4you Internet Services GmbH, Austria.
Server infrastructure and VPS services are provided by Contabo GmbH, Germany.
Processing is limited to technical operation, security, backups, maintenance and availability of the Platform.
Where required, data processing agreements pursuant to Article 28 GDPR are in place.
Administrative access may be protected through VPN services. In that context, connection data such as IP address and connection time may be processed for IT security purposes.

No proactive general monitoring takes place.
Reported content may be reviewed promptly. Violations of applicable rules may lead to deletion of content, warnings, restrictions or account suspension.
If review functions are available, review data such as ratings, review texts, timestamps, reviewer account reference and related moderation data may be processed, stored and displayed.
Legal basis: Article 6(1)(f) GDPR and where applicable Article 6(1)(b) GDPR.
Newsletters are sent after double opt-in registration.
For proof of consent, email address, timestamp and IP address may be stored.
Tracking or measurement features are used only where separately consented.

PayPal acts as an independent controller for payment processing under its own privacy terms.

We implement technical and organizational security measures including encryption, TLS/SSL, secure password hashing, access restrictions, updates, backups and security monitoring.

Where personal data is transferred to recipients outside the EU or EEA, such transfers take place only in accordance with applicable legal requirements.
